In accordance with article 38, caput of federal law 9610/1998, as well as article 14 of the Berne Convention, promulgated in Brazil through decree 75699/1975, the owner of this artistic work, when commercializing it, must transfer it to the artist or his successors, as a resale right, the amount corresponding to 50% (fifty) of the profit that may be earned with this new commercial transaction (resale) within a period of 30 days. If the author does not receive his resale right within the stipulated period, the seller is considered depositary of the amount owed to him, unless the transaction is carried out by an auctioneer, when this will be the depositary (as determined in the sole paragraph of article 38 of the federal law 9610/1998).
Alessandro Fracta (1997) is a visual artist from Manaus who currently resides and works between Manaus and Rio de Janeiro. His research is centered on a river memory, exploring the areas of sculpture and photography. He seeks to carry out work linked to his deep connection with the river of his origin, delving into local enchantments and the richness of family traditions. Fracta uses research and experimentation techniques, seeking to incorporate into his works elements and materialities that refer to his experience in the northern region of Brazil. In his creations, he seeks to transcend the boundaries of visual representation, seeking to capture the essence of the river and its stories, as well as exploring the intersections between nature, culture and personal identity, thus weaving a narrative that unites past and present.
