In accordance with article 38, caput of federal law 9610/1998, as well as article 14 of the Berne Convention, promulgated in Brazil through decree 75699/1975, the owner of this artistic work, when commercializing it, must transfer it to the artist or his successors, as a resale right, the amount corresponding to 50% (fifty) of the profit that may be earned with this new commercial transaction (resale) within a period of 30 days. If the author does not receive his resale right within the stipulated period, the seller is considered depositary of the amount owed to him, unless the transaction is carried out by an auctioneer, when this will be the depositary (as determined in the sole paragraph of article 38 of the federal law 9610/1998).

Claudia Tavares has a PhD in Contemporary Artistic Processes from IART
UERJ, Master in Arts from Goldsmiths College, London and in Visual Languages from EBA, UFRJ. As a visual artist, he mainly uses the languages of photography and video.
He participated in individual and collective exhibitions in spaces such as Espaço Cultural Sérgio Porto, Sesc Pinheiros, Galeria Murilo Castro (BH), Plataforma Revólver (Lisbon), 291 Gallery (London) Galeria Cozinha, Porto/Portugal, Casa Museu Abel Salazar, Porto/Portugal , Galeria Tempo (Rio de Janeiro), Palácio das Artes in Belo Horizonte, Paço Imperial in Rio de Janeiro, as well as art fairs such as SPArte, ArtRio and ArtBo (Bogotá).
He won the Faperj Nota 10 and PDSE Capes awards, during his doctoral research called Um Jardim em Floresta, which is also a photofilm, a visual arts exhibition and an object book, 1st place in the Chico Albuquerque Photography Award, from the Secretariat of Culture of Ceará 2019 and on the popular jury of the Cine_Ema Festival 2020.
She is the independent author of the photobook 10 verbs, 11 images, 1 memory.
